These terms and conditions apply to the use of Sprongsy, a product of van der Smissen - IT services. Sprongsy is a platform for generating AI children's stories, available at sprongsy.com.
By creating an account or using the service, you agree to these terms and our privacy.title.
2. Beta Phase
The service is offered as BETA
• Features may change, be added, or removed
• Interruptions, errors, or unexpected behavior may occur
• We reserve the right to modify the service without prior notice
• Feedback and bug reports are appreciated
By participating in the beta phase, you help us improve the service. You understand and accept that the service is still under development.
3. Service & Target Audience
Sprongsy is a platform for generating child-safe stories for children aged 4-10 years.
Important about users:
• Accounts are intended for adults (parents/guardians)
• Children may only use the app under adult supervision
• You must be at least 18 years old to create an account
• You are responsible for your children's use of the service
4. Account & Registration
To use the service, you must create an account.
Email: You must provide a valid email address that you have access to. This is used for authentication and communication.
Password: You are responsible for keeping your password secret. Choose a strong password of at least 8 characters.
Responsibility: You are responsible for all activities that occur under your account.
Age verification: When creating an account, you confirm via a checkbox that you are at least 18 years old.
Please note: If a minor creates an account by providing incorrect age information, full responsibility lies with the parent(s) or legal guardian(s). Sprongsy is not liable for use by minors.
5. Subscriptions & Prices
Sprongsy offers various subscription options:
Subscriptions:
An active subscription is required to generate stories. We offer the following plans, both monthly and yearly:

• New users receive a free 7-day trial upon registration
• During the trial you have access to all features with 5 audio credits
• You can cancel at any time during the trial — no charges will be made
• After the trial period ends, your subscription will be automatically activated and the first payment will be charged

Extra Audio Credits (individual purchase):
In addition to your subscription, you can purchase extra audio credits for the read-aloud function. These credits are valid for 12 months from the date of purchase and are used first when your monthly audio credits run out.

6. Automatic Renewal & Cancellation
Subscriptions are automatically renewed at the end of each payment period.
Renewal:
Monthly: Renews every month on the same date
Yearly: Renews every year on the same date
Reminder: You will receive a timely email reminder with the price and renewal date:
Monthly subscription: 7 days before renewal
Yearly subscription: 30 days before renewal (legally required)
Upon cancellation:
• You can cancel at any time via your account page
• You retain full access to your subscription until the end of the paid period
• Your subscription will not be automatically renewed after cancellation
• After the paid period ends, you can no longer generate new stories, unless you have purchased credits remaining (1 credit per story, including audio)
• Your account and all your saved stories remain available
• You can always continue to read and listen to your stories
• Extra purchased credits remain available for up to 12 months after purchase and can be used to create stories (1 credit per story, including audio)
When changing plans (upgrade/downgrade):
• Upgrades (e.g., Basic to Premium) take effect immediately and are charged immediately
• Downgrades (e.g., Premium to Basic) are scheduled for the end of your current billing period
• With a downgrade, you retain access to your current plan until the end of the paid period
• For mixed changes, interval precedence applies: annual to monthly always starts at period end; monthly to annual starts immediately.
24-hour cancellation period for plan changes
• Scheduled plan changes (downgrades) can only be canceled within 24 hours of creation
• After this 24-hour period, the change is final and cannot be undone via your account
• You will receive a confirmation email with this information when you make a plan change
You can request deletion of your account and all data at any time via your account page. If you have an active paid subscription, the permanent deletion is scheduled at the end of your paid period: you keep access until then, no further payments will be charged, and you can cancel your deletion request before that date. There is no refund for the already paid period.
7. Right of Withdrawal & Refund Policy
At Sprongsy, we offer all users in the Netherlands and the United Kingdom a 14-day cooling-off period after purchasing a subscription. This goes beyond the legal requirements, because we believe you should be able to choose with peace of mind.
How does it work?
• You can cancel your subscription within 14 days of registration without giving any reason and receive a full refund
• This applies to new subscriptions, not to renewals
• Refund will be processed within 14 days of receiving your request
Trial & right of withdrawal
During the free 7-day trial, no payment is charged. If you cancel during the trial, you pay nothing. The statutory 14-day right of withdrawal begins from the moment of registration. The 7-day trial therefore falls within these 14 days.
Exception for immediate use
If you generate stories during the cooling-off period, you agree that the service starts immediately. You retain your right of withdrawal, but upon refund we may deduct a proportionate amount for services already used (generated stories).
8. Payments
All payments are processed by Stripe, Inc., our payment provider.
• Stripe accepts credit cards and other payment methods
• You receive invoices and receipts directly from Stripe
• Prices include VAT
• Refunds are processed through Stripe or on request through us
• If a payment fails, Stripe retries collection according to the configured retry schedule.
• If payment remains outstanding, access to paid features may be limited or suspended until payment is restored.
• You can securely update your payment method at any time via the Stripe customer portal from your account page.
• Prices are displayed in your country's local currency, as determined by Stripe
• The price you see at checkout is the final price
• Exchange rate differences may lead to variations in the invoice amount
• VAT or local taxes are automatically calculated based on your location
Please note: By completing a purchase, you agree to the price displayed at checkout at that moment.
9. AI-Generated Content
The stories and audio are generated using AI technology from OpenAI.
Important disclaimers:
• Stories are not guaranteed to be correct, unique, or error-free
• AI may generate unexpected or inaccurate output
• Although we perform safety checks, 100% child safety is not guaranteed
• The service is not intended for educational, medical, or professional advice
• Stories are intended for entertainment purposes
Safety measures: All generated stories are automatically checked for child safety. Stories that do not pass the check are not saved.
10. Story Limits & Fair Use Policy
Both subscriptions let you generate up to 200 stories per month (fair use). The limit is on audio credits for the read-aloud function: Basic offers 10 audio credits per month, Premium offers 20 audio credits per month. A fair use limit of 200 stories per month applies to prevent abuse.
• Subscription limits are reset monthly on the first day of the month
• Unused subscription stories are not carried over to the next month
• Extra stories (individual purchases) do not expire and remain available
• Extra credits are used first when your monthly limit is reached
• You can upgrade to a higher subscription for more stories per month
Fair Use Policy (Premium)
• Premium stories with a fair use limit are intended for normal family use
• The fair use limit is 200 stories per month – more than enough for daily use
• This limit protects against automated abuse and ensures fair service for all users
• If the fair use limit is exceeded, we reserve the right to contact you or restrict the account
11. Intellectual Property
Our rights
The Sprongsy platform, characters (Sprongsy, Novi, Tikko), design, source code, and all related intellectual property rights remain the property of van der Smissen - IT services.
Your rights
The stories you generate are for personal, non-commercial use. You may share the stories with your family and read them to your children.
Not allowed
• Commercial use of generated stories
• Publication or sale of stories as your own work
• Copying or reverse-engineering of the platform
12. Acceptable Use
By using Sprongsy, you agree to the following:
Allowed:
• Generate stories for personal use
• Read stories to your children
• Share stories within your household
• Provide feedback about the service
Not allowed:
• Abuse the service or overload systems
• Attempt to bypass security checks
• Share accounts with others outside your household
• Use the service for illegal purposes
• Automated access without permission
• Attempt to gain unauthorized access
13. Liability
To the extent permitted by law, van der Smissen - IT services (Sprongsy) is not liable for:
• Indirect, incidental, or consequential damages
• Loss of data due to technical problems
• Errors, inaccuracies, or inappropriate content in AI-generated stories
• Interruptions or unavailability of the service
• Actions of third parties (Stripe, OpenAI, etc.)
• Decisions made based on AI-generated content
Maximum liability: Our total liability is limited to the amount you have paid to Sprongsy in the past 12 months.
14. Indemnification
You indemnify van der Smissen - IT services (Sprongsy) against all claims, damages, and costs (including reasonable attorney fees) arising from:
• Your violation of these terms
• Your use of the service
• Your violation of third-party rights
15. Termination
By you:
You can delete your account at any time via your account page. Upon deletion, all your data will be permanently deleted.
By us:
We reserve the right to terminate or suspend accounts in case of:
• Violation of these terms
• Abuse of the service
• Termination of the beta phase
• Other reasons at our reasonable discretion
16. Changes
We may modify these terms from time to time. For significant changes:
• You will receive an email notification
• The change takes effect after a reasonable period
• The "last update" date is updated
Continued use of the service after changes means acceptance of the new terms.
17. Netherlands & United Kingdom
Sprongsy focuses on the Netherlands and the United Kingdom. The following provisions apply:
General
• The service is offered from the Netherlands
• Prices are displayed in your country's currency, including VAT
• You are responsible for compliance with local legislation in your country
• The interface is available in multiple languages (Dutch, English, German, Spanish, French, Portuguese)
United Kingdom
• UK GDPR rights are respected (see our Privacy Policy)
• Payments are processed by Stripe (US); UK/EEA customers retain applicable consumer rights
• You can file complaints with the Information Commissioner's Office (ICO)
European Union
• Full GDPR rights apply
• You can file complaints with your local supervisory authority
• Consumer rights under EU law remain in effect
Age Requirements
Regardless of your location: you must be at least 18 years old to create an account. Children may only use the app under the supervision of a parent or guardian.
Verification: Upon registration (via email or Google), you confirm via a checkbox that you are 18 years or older and agree to our terms. By creating an account, you declare that this information is correct. We reserve the right to delete accounts we suspect were created by minors.
Parental/Guardian Responsibility
Important: If a minor creates an account by providing incorrect information about their age, full responsibility lies with the parent(s) or legal guardian(s) of the minor.
• Parents/guardians are responsible for supervising their children's internet use
• Van der Smissen - IT services (Sprongsy) is not liable for use of the service by minors who provided incorrect age information
• By giving your child access to a device that can reach our platform, you as parent/guardian accept full responsibility for any use by your child
• We do not perform technical age verification and rely on the honesty of self-declaration during registration
• If we discover that an account was created by a minor, we will delete this account and all associated data without right to refund
18. Governing Law & Disputes
These terms are governed by Dutch law, regardless of your location.
• Disputes are preferably resolved through mutual consultation
• In case of unresolvable disputes, the courts in the Netherlands have jurisdiction
• This does not affect any mandatory consumer rights under EU or local legislation
Please note: If you are a consumer in the EU/EEA or UK, you may have the right to bring disputes before a court in your place of residence. This right is not limited by these terms.
19. Force Majeure
Van der Smissen - IT services (Sprongsy) is not liable for failure or delay in fulfilling obligations due to circumstances beyond our reasonable control, including but not limited to:
• Natural disasters, war, terrorism, or civil unrest
• Disruptions to electricity, internet, or telecommunications networks
• Disruptions at third parties we depend on (OpenAI, Supabase, Stripe, etc.)
• Pandemics or other public health emergencies
• Government measures, legislative changes, or court decisions
• Cyberattacks, DDoS attacks, or other malicious activities
In case of force majeure, we will endeavor to inform you as soon as possible and resume service as soon as circumstances permit.
20. Service Availability
We strive to keep our service as available as possible, but cannot guarantee 100% uptime.
• We do not guarantee a specific availability percentage (SLA)
• Scheduled maintenance is announced in advance where possible
• During the beta phase, interruptions may occur more frequently
• We are not liable for damages resulting from unavailability
• PWA installation (Download app) depends on browser support and device settings
• Offline listening works only for stories you explicitly download on this device. This is a best-effort feature and may be affected by storage limits or automatic cache cleanup by the browser or operating system

Feature Changes
We reserve the right to modify, expand, or discontinue features or parts of the service, with or without prior notice:
• Modification or expansion of story themes and characters
• Updates to AI models or text-to-speech voices
• Adding or removing language options
• Adjustments to the interface and navigation
• Introduction of new features or games
• Discontinuation of experimental or beta features
For material changes that significantly affect core functionality, we will inform you by email.
21. Electronic Communications
By creating an account, you consent to receiving electronic communications from us, including:
• Reminders about your subscription and upcoming renewals
• Important changes to these terms or our privacy policy
Marketing: You will only receive newsletters and promotional emails if you have subscribed. You can always unsubscribe via the link in the email or through your account settings.
22. Entire Agreement
These terms and conditions, together with our Privacy Policy, constitute the entire agreement between you and van der Smissen - IT services (Sprongsy) regarding the use of our service. These terms supersede all prior agreements, arrangements, or statements, oral or written.
23. No Waiver
The failure or delay by us to exercise any right or remedy under these terms does not constitute a waiver of that right or remedy. A single or partial exercise of a right or remedy does not preclude further exercise thereof.
24. Assignment
You may not transfer your rights or obligations under this agreement to third parties without our prior written consent.
We may transfer our rights and obligations under this agreement to a third party, for example in case of a business acquisition or merger. In that case, we will inform you.
25. Severability
If any provision of these terms is declared invalid or unenforceable, the remaining provisions remain in full force and effect. The invalid provision will be replaced by a valid provision that most closely approximates the intended purpose.
